Licensed, Non-Licensed & Notifiable Non-Licensed Work (NNLW) Guidance

The Control of Asbestos Regulations 2012 introduced a three-tier classification system for work with asbestos: licensed work, notifiable non-licensed work (NNLW), and non-licensed work. Correctly classifying the work is essential — using the wrong category can result in HSE enforcement action, prohibition notices, and significant legal liability.

Work Classification Assessment: Our consultants assess planned works against the regulatory criteria defined in CAR 2012 and the HSE's guidance document HSG210 'Asbestos Essentials'. We evaluate the asbestos type, material condition, extent of the work, duration of exposure, and the degree of fibre release likely to occur. This assessment determines whether works require a licensed contractor, fall under NNLW notification requirements, or can proceed as non-licensed work.

Licensed Work Guidance: Where works are classified as licensed (typically involving loose-fill insulation, sprayed coatings, lagging, or any work where exposure may exceed the control limit), we advise on the appointment of HSE-licensed contractors, the requirement for a 14-day ASB5 notification to the HSE, and the need for independent analyst oversight including four-stage clearance.

NNLW Notification Support: For notifiable non-licensed work — a category that catches many contractors and dutyholders unaware — we provide full support including preparation of the ASB5 notification form, risk assessment and plan of work review, health record and medical surveillance requirements, and guidance on designated areas and decontamination procedures.

Non-Licensed Work Procedures: For lower-risk non-licensed work, we provide risk assessments, method statement reviews, and practical guidance on safe working procedures, control measures, and waste disposal requirements. Even non-licensed work requires a written risk assessment and plan of work under CAR 2012.

Risk Assessment and Method Statement (RAMS) Review: We review contractor RAMS for all categories of asbestos work, ensuring they are adequate, site-specific, and compliant with current regulations. This protects the dutyholder from liability if works are not conducted to the required standard.
