1. Introduction

These Terms and Conditions ("Terms") govern the provision of asbestos survey and consultancy services by Asbestosurv ("we", "us", "our") to you ("Client", "you", "your").

By engaging our services, you agree to be bound by these Terms. Please read them carefully.

2. Services Provided

We provide professional asbestos consultancy services including but not limited to:

  • • Asbestos Management Surveys (HSG264 Type 2)
  • • Refurbishment & Demolition Surveys (HSG264 Type 3)
  • • Asbestos Re-Inspection Surveys
  • • Asbestos Sampling & UKAS-Accredited Laboratory Analysis
  • • Asbestos Management Plans and Registers
  • • Air Monitoring & Clearance Testing (HSG248)
  • • Asbestos Project Management and Consultancy

All services are conducted in accordance with the Control of Asbestos Regulations 2012 (CAR 2012) and HSG264 guidance.

3. Client Responsibilities

The Client agrees to:

  • • Provide accurate property information and access arrangements
  • • Ensure safe access to all areas requiring survey
  • • Inform us of any known hazards or restricted areas
  • • Provide building plans or drawings where available
  • • Ensure appropriate persons are notified of survey activities
  • • Grant permission for intrusive inspection where required
  • • Make payment in accordance with agreed terms

4. Quotations & Payment

Quotations: All quotations are valid for 30 days from the date of issue and are subject to site access and information provided being accurate.

Payment Terms: Payment is due within 30 days of invoice date unless otherwise agreed in writing. We reserve the right to charge interest on overdue invoices at 8% above the Bank of England base rate.

Cancellations: Cancellations made less than 48 hours before a scheduled survey may incur a cancellation fee of 50% of the quoted price.

5. Survey Limitations

Our surveys are subject to the following limitations:

  • Access: Surveys are limited to areas accessible at the time of inspection. Inaccessible areas will be noted in the report.
  • Presumption: Where materials cannot be sampled, we will presume they contain asbestos unless proven otherwise.
  • Visual Inspection: Management surveys involve primarily visual inspection with minimal intrusion.
  • Hidden Materials: Concealed materials within walls, floors, ceilings, or enclosed spaces may not be identified unless a Refurbishment & Demolition survey is specified.
  • Sample Analysis: Laboratory results are dependent on the representativeness of samples taken.

6. Reports & Recommendations

Survey reports are provided for the exclusive use of the named Client and the specific property surveyed. Reports include:

  • • Material locations and descriptions
  • • Material risk assessments
  • • Priority risk assessments
  • • UKAS-accredited laboratory certificates
  • • Recommendations for management or removal

Reports must not be reproduced, distributed, or relied upon by third parties without our written consent. We accept no liability for decisions made by third parties based on our reports.

7. Liability

Professional Indemnity: We maintain professional indemnity insurance of £5,000,000.

Limitation: Our liability for any claim arising from our services is limited to the fee charged for those services, except in cases of death, personal injury, fraud, or where limitation is prohibited by law.

Exclusions: We are not liable for:

  • • Decisions made by the Client based on our recommendations
  • • Work carried out by third-party contractors
  • • Materials in inaccessible areas not surveyed
  • • Changes to property condition after survey completion
  • • Indirect, consequential, or economic losses

8. Intellectual Property

All reports, documents, and materials produced remain our intellectual property. The Client is granted a non-exclusive licence to use reports for the purpose for which they were commissioned. Reproduction or distribution requires written permission.

9. Data Protection

We process personal data in accordance with UK GDPR and our Privacy Policy. Survey records are retained for 40 years in compliance with CAR 2012 health record requirements.

10. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Quality Standards

Asbestosurv operates in accordance with:

  • • HSG248 Asbestos: The Analysts' Guide
  • • UKAS ISO/IEC 17025 for laboratory analysis

12. Amendments

We reserve the right to amend these Terms. Updated Terms will be published on our website with a revised effective date. Continued use of our services constitutes acceptance of amended Terms.
